Awaab’s Law Phase 2: why excess cold, excess heat and room-condition evidence now matter

From 30 November 2026, Awaab’s Law Phase 2 extends social-landlord obligations to additional hazards, including excess cold and excess heat where they present a significant risk of harm.

For housing providers, this makes room conditions a much more operational issue. The question is no longer simply whether a repair has been logged. It is whether the landlord can understand, prioritise and evidence what is happening inside the home before, during and after intervention.

What is changing under Awaab’s Law Phase 2?

Awaab’s Law introduced statutory requirements for social landlords to respond to serious hazards within defined timeframes. Phase 1 focused on emergency hazards and significant damp and mould hazards.

Phase 2 comes into force on 30 November 2026 and extends the significant-hazard requirements to a wider group of risks, including excess cold and excess heat where they present a significant risk of harm.

The practical change for housing teams

Excess cold and excess heat become more than seasonal comfort issues. They become indoor-condition risks that may need to be investigated, prioritised, acted upon and evidenced within a defined process.

Why this changes the evidence question

Many room-condition issues are currently discovered through complaints, periodic inspections, resident feedback or manual investigation. Those routes still matter, but they can leave housing teams reacting after the problem has already escalated.

Awaab’s Law Phase 2 increases the value of earlier evidence. If a resident reports that a room is dangerously cold, too hot, damp or unhealthy, the landlord needs to understand:

  • how severe the condition is;
  • when it occurs and how long it persists;
  • whether the issue is isolated or part of a wider building pattern;
  • whether vulnerable residents may be affected;
  • what action was taken; and
  • whether the intervention actually improved the room condition.

This is where room-level monitoring and heating control can support housing teams. Temperature, humidity, CO₂ and heating-control data can help identify which homes or rooms are persistently outside expected conditions and whether intervention has restored a safer, more comfortable environment.

Monitoring helps identify the problem. Control helps resolve it.

Environmental monitoring gives landlords visibility. It can show where rooms are too cold, too hot, humid or poorly ventilated. That is valuable, especially where estates are large, dispersed or difficult to inspect regularly.

But monitoring alone only tells the team that a problem may exist. The stronger operational model is:

The balance: protect residents without wasting heat

Awaab’s Law Phase 2 also lands at a time when energy-cost pressure remains high. Social landlords need to protect residents from excess cold and excess heat, while also controlling avoidable consumption across their estates.

Those aims should not be treated as separate issues. A poorly controlled estate can have both comfort risk and energy waste:

  • some homes may be persistently too cold;
  • some rooms may be overheating overnight;
  • communal systems may be difficult to control;
  • heating may run when it is not required;
  • similar buildings may behave very differently; and
  • interventions may be hard to verify without room-level data.

Better room-condition evidence helps landlords make more precise decisions. It allows teams to focus attention on the properties and rooms that actually show risk, rather than relying only on estate averages, assumptions or the loudest complaint.

Questions housing providers should be asking now

Can we see excess cold risk early?

Are there homes or rooms that repeatedly fall below acceptable temperatures before the resident complains?

Can we see excess heat risk?

Do we know which homes overheat in summer or remain too warm overnight?

Can we evidence humidity and ventilation issues?

Are we identifying the conditions that can contribute to damp, mould or poor indoor air quality?

What about student accommodation and boarding schools?

Awaab’s Law is specific to social housing, and the legal duties should not be presented as applying directly to student accommodation or independent schools.
